City head of lititgation to chair SRA

Charles Plant, former head of litigation at City firm Herbert Smith, is to become chairman of the SRA in January next year, the Law Society has announced. His appointment comes at a crucial time for regulation of the profession, with the Legal Services Board expected to take on most of its powers under the Legal Services Act in January. By the end of this year, the LSB must finalise its rules for the separation of powers between regulatory and representative bodies.

The division of functions between the Society and the SRA has already been the subject of much debate, and the appointment of Plant and his board may be the last time that the Society has the dominant role. Peter Williamson, current chairman of the SRA, called in May for the Society to reconsider its approach to appointing the new chairman and board in the light of the LSB’s plans for “ring-fencing” from the Society (see Solicitors Journal 12 May 2009). Meanwhile Lord Hunt of Wirral is considering the question of whether the SRA should set up a separate unit to regulate the top City firms.

His report is due later this year. “I know that the SRA board, like other legal regulators, faces significant challenges in developing its approach to ensure it is an effective, modern regulator of firms of all shapes and sizes, including Alternative Business Structures,” Plant said. He is currently a consultant at Herbert Smith and chairman of the governors of the College of Law.
